Bakgrunn
(fra kommisjonsforordningen)
(1) Regulation (EC) No 1069/2009 lays down public health and animal health rules for animal by-products and derived products not intended for human consumption, including rules on imports into and transit through the Union, and on export from the Union, of such products.
(2) Commission Regulation (EU) No 142/2011 lays down public health and animal health rules for animal by-products and derived products governed by Regulation (EC) No 1069/2009. In particular, Annex XIV to Regulation (EU) No 142/2011 lays down rules concerning the import, export and transit of such products.
(3) Following assessments by the Commission services of requests and the relevant information submitted by the competent authorities of Uzbekistan and Vietnam, the Commission reached a favourable technical conclusion on the eligibility of those third countries to be included in the lists of third countries or parts thereof set out in Annex XIV to Regulation (EU) No 142/2011, as authorised for import into the Union of certain aquatic crustaceans only to be used as petfood from Uzbekistan, or of processed animal protein of insect origin, rendered fats of insect origin and processed petfood containing animal protein of insect origin from Vietnam. Table 1 in Chapter I, Section 1 and Table 2 in Chapter II, Section 1, of that Annex should, therefore, be amended accordingly.
(4) Article 43(3) of Regulation (EC) No 1069/2009 prohibits exports from the Union of, among others, Category 2 material such as processed frass, if destined for incineration or landfill. However, export of that Category 2 material for other purposes than those referred to in Article 43(1) and (2) of that Regulation may be allowed, provided that rules for such export have been laid down in Chapter V of Annex XIV of Regulation (EU) No 142/2011.
(5) Following requests from Member States and stakeholders to enable the marketing of processed frass in third countries, the requirements for export of processed frass from the Union should be laid down in the Table in Chapter V of Annex XIV to Regulation (EU) No 142/2011. For reasons of proportionality and simplification those requirements should be the same as the standard processing conditions established for the placing on the market of processed frass within the Union. Chapter V of that Annex should, therefore, be amended accordingly.
(6) Annex XIV to Regulation (EU) No 142/2011 should, therefore, be amended accordingly.
(7) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
