(1) Pursuant to Regulation (EC) No 391/2009, the Commission is responsible for granting recognition to ship inspection and survey organisations wishing to be authorised to provide services on behalf of the Member States. Pursuant to Article 8(1) of that Regulation the Commission is also required to regularly assess recognised organisations to ensure that they continue to meet the requirements of that Regulation.

(2) As part of that assesment, the Commission verifies that the holder of the recognition granted is the relevant legal entity within the organisation to which the provisions of Regulation (EC) No 391/2009 apply, within the meaning of in accordance with Article 2(c) and Article 4(3) of that Regulation. Where that is not the case, the Commission should take a decision amending that recognition.

(3) By Commission Implementing Decision C(2017) 1881 following information provided by the Bureau Veritas SA – Registre international de classification de navires et d’aeronefs (BV), the recognition previously granted to that legal entity was transferred to the legal entity ‘Bureau Veritas Marine & Offshore SAS’.

(4) The latest list of organisations recognised on the basis of Regulation (EC) No 391/2009 was published in the Official Journal of the European Union on 8 July 2017, pursuant to Commission Decision (EU) 2015/669 . In that list Bureau Veritas Marine & Offshore SAS (BV) is named as a recognised organisation.

(5) Pursuant to Article 8(1) the Commission carried out an assessment of Bureau Veritas Marine & Offshore SAS. The Commission verified, in particular, whether the holder of the recognition is the relevant legal entity within the organisation to which the provisions of Regulation (EC) No 391/2009 apply.

(6) The Commission concluded that Bureau Veritas Marine & Offshore SAS is no longer the relevant legal entity within the organisation to which the provisions of Regulation (EC) No 391/2009 apply. Therefore, the recognition of Bureau Veritas Marine & Offshore SAS should be amended and the holder of that recognition should be ‘Bureau Veritas SA’, which is which is the parent entity of all legal entities that constitute the recognised organisation within the meaning of Article 4(3) of Regulation (EC) No 391/2009.

(7) The purpose of the present amendment is to indicate the correct identity of the legal entity which should be considered as a holder of the recognition granted to Bureau Veritas Marine & Offshore SAS. This amendment is without prejudice to the Commission’s assessment, carried out pursuant to Article 8(1) of Regulation (EC) 391/2009, to verify that the recognised organisation in question meets the obligations under that Regulation and fulfils the minimum criteria set out in its Annex I.

(8) The measures provided for in this Decision are in accordance with the opinion of the Committee on Safe Seas and the Prevention of Pollution from Ships established by Regulation (EC) No 2099/2002 of the European Parliament and of the Council
