(1) Commission Implementing Regulation (EU) 2026/103 renewed the authorisation of a preparation of Enterococcus lactis DSM 7134 for a period of 10 years as a feed additive for sows in the category ‘zootechnical additives’ and the functional group ‘gut flora stabilisers’. Implementing Regulation (EU) 2026/103 also repealed Commission Implementing Regulation (EU) No 1083/2014.
(2) Transitional measures are usually provided upon renewal of the authorisation of a feed additive, allowing interested parties to prepare for any modification of the terms of the authorisation, where safety reasons do not require the immediate application of such modification. However, Implementing Regulation (EU) 2026/103 erroneously omitted to provide for such transitional measures that would allow interested parties to prepare for the new requirement consisting of the new name of the additive included in the renewed authorisation and no reason, including safety reasons, required the immediate application of that change of name.
(3) Implementing Regulation (EU) 2026/103 should therefore be corrected accordingly by providing for transitional measures concerning the placing on the market and use of the preparation of Enterococcus faecium DSM 7134, as authorised by Implementing Regulation (EU) No 1083/2014 for use for sows.
(4) To prevent market disturbance and detrimental consequences for the operators concerned due to the absence of transitional measures in Implementing Regulation (EU) 2026/103, this Regulation should enter into force as a matter of urgency and apply retroactively from the date of entry into force of Implementing Regulation (EU) 2026/103.
(5) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
