(1) Annex 5-E to the Comprehensive Economic and Trade Agreement (CETA) between Canada, of the one part, and the European Union and its Member States, of the other part (3), (‘the Agreement’) establishes the public health and animal health measures for import into the Union of certain animals and animal products for which equivalence is to be recognised.
(2) Annex 5-I to the Agreement provides for health attestations to be included in the model animal health/official certificate for import into the Union of certain animals and animal products for which equivalence of measures has been recognised.
(3) Equivalence has been recognised with regard to certain public health requirements for import into the Union of fresh meat intended for human consumption of domestic porcine animals from Canada but not for animal health requirements. Therefore, the simplification of the model certificate should only concern the public health attestation of the model animal health/official certificate for import into the Union of fresh meat intended for human consumption of domestic porcine animals from Canada. The animal health attestation of that model certificate should replicate the animal health attestation in the model animal health/official certificate for the entry into the Union of fresh meat intended for human consumption, excluding mechanically separated meat, of domestic porcine animals (MODEL POR) set out in Chapter 3 of Annex III to Commission Implementing Regulation (EU) 2020/2235 (4).
(4) Article 118(1) of Regulation (EU) 2019/6 of the European Parliament and of the Council (5) read in combination with Article 107(2) of that Regulation establishes the requirement, for the entry into the Union of consignments of animals or products of animal origin from third countries that no antimicrobial medicinal products were used to promote growth or to increase yield in the animals concerned. In addition, medicinal products containing antimicrobials that are included in the list of antimicrobials reserved for the treatment of certain infections in humans laid down in Commission Implementing Regulation (EU) 2022/1255 (6) cannot have been used in respect of animals or products of animal origin in order to allow for their entry into the Union from third countries.
(5) Commission Delegated Regulation (EU) 2023/905 (7) supplements Regulation (EU) 2019/6 by establishing conditions for the entry into the Union of consignments of live food-producing animals and products of animal origin intended for human consumption that are exported from third countries to the Union.
(6) Article 4 of Delegated Regulation (EU) 2023/905 specifies, in particular, that consignments of food-producing animals and products of animal origin intended for human consumption may only enter the Union where they are accompanied by an official certificate attesting compliance with the Union rules on the use of antimicrobial medicinal products established in Regulation (EU) 2019/6 and in Delegated Regulation (EU) 2023/905.
(7) An attestation concerning compliance with these Union rules should therefore be inserted in the model certificate set out in Annex II to Commission Decision 2005/290/EC (8).
(8) In the interests of clarity and consistency of Union rules, the model certificate set out in Annex II to Decision 2005/290/EC should be updated, including updating references, notes and structural elements, and be replaced by the model certificate set out in the Annex to this Decision.
(9) Decision 2005/290/EC should therefore be amended accordingly.
(10) To avoid any disruption to trade as regards the entry into the Union of consignments of fresh meat intended for human consumption of domestic porcine animals from Canada, the use of the model animal and public health certificate for fresh meat of domestic swine consigned to the Union from Canada issued in accordance with Annex II to Decision 2005/290/EC, as applicable before the amendments made to that Annex by this Decision, should continue to be accepted for the entry into the Union during a transitional period until the date of entry into application of the model animal health/official certificate set out in the Annex to this Decision.
(11) The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
