(1) Commission Implementing Decision 2012/119/EU lays down rules concerning guidance on the collection of data and on the drawing up of best available techniques (BAT) reference documents (BREFs) and on their quality assurance referred to in Article 13(3), points (c) and (d), of Directive 2010/75/EU.
(2) Directive (EU) 2024/1785 of the European Parliament and of the Council introduced substantial amendments to Directive 2010/75/EU. Those amendments provide, in particular, for: new environmental objectives; enhanced roles for the Commission — notably through the establishment of the Innovation Centre for Industrial Transformation and Emissions (INCITE) — as well as for the European Chemicals Agency (ECHA); a defined duration for the exchange of information and for the review cycle of BREFs; strengthened rules on the handling of confidential business information and commercially sensitive information; and new requirements for the permits that Member States grant to operators of industrial plants.
(3) Pursuant to Article 14(3) of Directive 2010/75/EU, BAT conclusions set out in BREFs must be the reference for setting permit conditions. Therefore, in order to ensure coherence with the amendments of Directive (EU) 2024/1785, and in accordance with Article 13(1a) of Directive 2010/75/EU, the provisions of Decision 2012/119/EU must be updated by 1 July 2026.
(4) In accordance with Article 13(3), point (c), of Directive 2010/75/EU, the Commission obtained the opinion of the forum on this Decision on 2 March 2026.
(5) The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 75 of the Directive,
