Bakgrunn

(1) Annex II to Commission Implementing Regulation (EU) 2021/1378 contains the list of control authorities and control bodies recognised in accordance with Article 46(1) of Regulation (EU) 2018/848 as competent to carry out controls and issue organic certificates in third countries for the purpose of imports of organic products into the Union in accordance with Article 45(1), point (b)(i), of that Regulation.
(2) Article 46(2) of Regulation (EU) 2018/848 lays down the criteria that the control authorities and control bodies must fulfil in order to be recognised in accordance with Article 46(1) of that Regulation. Commission Delegated Regulation (EU) 2021/1698 lays down the procedural requirements to be met by those control authorities and control bodies when submitting to the Commission their request for recognition consisting of a technical dossier.
(3) The Commission has received and examined, in accordance with Article 1 of Delegated Regulation (EU) 2021/1698, the requests for recognition from ‘Bio Latina Certificadora’, ‘Primus Auditing Operations Mexico’ and ‘PT BIOCert Indonesia’. Based on the information contained in their technical dossiers, the Commission has concluded that it is justified to recognise, for an indefinite duration, those control bodies for certain product categories in certain third countries.
(4) The Commission has also received and examined, in accordance with Article 2 of Delegated Regulation (EU) 2021/1698, the requests for the extension of the scope of their recognition to certain product categories and certain third countries from ‘Australian Certified Organic Pty. Ltd’, ‘ACT Organic Company Limited’, ‘CCPB Srl’, ‘Ecocert SAS’, ‘Mayacert S.A.’ and ‘OneCert International Private Limited’. Based on the information contained in their technical dossiers, the Commission has concluded that it is justified to recognise, for an indefinite duration, those control bodies for the requested product categories and third countries.
(5) The Commission acknowledges receipt of notification from ‘Balkan Biocert Macedonia DOOEL Skopje’ of its intention to voluntarily relinquish its recognition. Based on this notification, the Commission has concluded that it is appropriate to remove this control body from the list of recognised control bodies set out in Annex II of Implementing Regulation (EU) 2021/1378.
(6) Commission Implementing Regulation (EU) […] extended the scope of the recognition of Japan for the purposes of equivalence to live animals and unprocessed animal products as well as to all processed agricultural products for use as food, including wine and alcoholic beverages, with organically grown ingredients that have been grown in Japan, or imported into Japan from the European Union, from third countries whose production methods and control measures have been recognised by Japan as equivalent to those laid down in the Japanese legislation, or from third countries through the system of control bodies recognised by Japan as competent to certify operators in those third countries as complying with the organic production rules of Japan. Consequently, those product categories no longer need to be included in the list of product categories of recognised control authorities and control bodies in accordance with Article 2(1), point (b), of Implementing Regulation (EU) 2021/1378, and the control bodies ‘Control Union Certifications B.V.’, ‘Ecocert SAS’, ‘Japan Organic and Natural Foods Association’ and ‘Organic Crop Improvement Association International Inc’, listed in Annex II to that Regulation are therefore no longer competent to carry out controls and issue organic certificates for them in Japan for the purpose of their import into the Union.
(7) Implementing Regulation (EU) 2021/1378 should therefore be amended accordingly.
