(1) Regulation (EC) No 1069/2009 lays down rules for the collection, use and disposal of animal by-products and derived products, including rules for feeding Category 1 material to endangered or protected species of necrophagous birds in their natural habitat and for the labelling of animal by-products.
(2) Commission Regulation (EU) No 142/2011 lays down implementing measures in regard to rules applicable to animal by-products and derived products not intended for human consumption laid down in Regulation (EC) No 1069/2009, including special rules on animal feeding and rules on the collection, transport and traceability of animal by-products.
(3) Chapter IV, Section 3, of Annex IV to Regulation (EU) No 142/2011 lays down rules for the disposal and use of derived products. New alternative processing methods for the production of renewable fuels were introduced by Commission Regulation (EU) 2025/1377 in Chapter IV, Section 2, of Annex IV to Regulation (EU) No 142/2011 for the production of biodiesel from processed and rendered fats of Category 1, Category 2 and Category 3 materials. However, these new methods are not yet included in Chapter IV, Section 3, of Annex IV to Regulation (EU) No 142/2011 regarding the authorised disposal and use of certain derived products. Therefore, Chapter IV, Section 3, of Annex IV to Regulation (EU) No 142/2011 should be amended to include, within the scope of the provisions on authorised disposal and use, the products resulting from the newly introduced alternative processing methods for the production of renewable fuels.
(4) In accordance with the rules on special feeding purposes laid down in Article 18(2), point (b), of Regulation (EC) No 1069/2009 and by way of derogation from Article 12 thereof, the competent authority may authorise the feeding of Category 1 material (e.g.: fallen stock) to endangered or protected species of necrophagous birds and other species living in their natural habitat, for the promotion of biodiversity.
(5) Chapter II, Section 2, point 1(a)(i), of Annex VI to Regulation (EU) No 142/2011 lays down the list of Member States in which Category 1 material may be fed to endangered and protected species of necrophagous birds, as well as the species of necrophagous birds that may be fed Category 1 material. The Commission received a formal request from Romania to be included in that list of Member States. Therefore, Annex VI to Regulation (EU) No 142/2011 should be amended accordingly.
(6) Chapter V, point 1, of Annex VIII to Regulation (EU) No 142/2011 provides that certain Category 1 and Category 2 derived products are to be marked with ‘glyceroltriheptanoate (GTH)’ to identify the presence of Category 1 and Category 2 derived products in feed for farmed animals. The final products of the recently introduced alternative processing methods for the production of renewable fuels should be excluded from this marking obligation insofar as these products are used for internal combustion engines, since these products cannot be used as feed. Therefore, Annex VIII to Regulation (EU) No 142/2011 should be amended to exclude such biodiesel produced from processed and rendered fats of Category 1, Category 2 and Category 3 materials from this obligation.
(7) Annexes IV, VI and VIII to Regulation (EU) No 142/2011 should, therefore, be amended accordingly.
(8) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed,
