Suspension of the derivatives trading obligation under MiFIR for specific banks
Article 32a of Regulation (EU) No 600/2014 on the markets in financial instruments allows the Commission to suspend, by way of an implementing act, the derivative trading obligation with respect to certain financial counterparties, upon request of a competent authority of a Member State and provided that certain conditions are met. The Commission has received and positively assessed requests from two competent authorities of a Member State with a view to suspend the derivative trading obligation. To this end, the Commission prepared a draft implementing act that suspends the derivative trading obligation for four requesting financial counterparties.
