1. Bakgrunn og status
Dokument: Directive 2007/30/EC of the European Parliament and of the Council of 20 June 2007 amending Council Directive 89/391/EEC, its individual Directives and Council Directives 83/477/EEC, 91/383/EEC, 92/29/EEC and 94/33/EC with a view to simplifying and rationalising the reports on practical implementation.
Status: Direktivet ble vedtatt 20.06.2007 og publisert i Official Journal 27.06.2007.
Implementeringsfrist: 31.12.2012
Direktivets formål:
En rekke direktiver pålegger medlemsstatene å rapportere om gjennomføringen av direktiver på HMS-området. De ulike direktivenes bestemmelser om slik rapportering stiller ulike krav til hyppigheten og innholdet i rapporteringen. Direktivet tar sikte på å harmonisere rapporteringshyppigheten og innholdet i rapportene.
Rapportering i henhold til de ulike direktivene skal nå skje hvert femte år. Den første rapporten skal imidlertid dekke en lengre periode. Strukturen skal være mest mulig konform, og dette skal sikres ved at rapporteringen skjer gjennom besvarelse av et spørreskjema formulert av Kommisjonen.
Endringer i eksisterende direktiver (allerede en del av EØS-avtalen):
Følgende direktiver harmoniseres med hensyn til rapporteringens innhold og hyppighet:
* Directive 89/391/EEC on the introduction of measures to encourage improvements in the safety and health of workers at work
* Directive 83/477/EEC on the protection of workers from the risks related to exposure to asbestos at work
* Directive 91/383/EEC
* Directive 92/29/EEC on the minimum safety and health requirements for improved medical treatment on board vessels
* Directive 94/33/EC on the protection of young people at work
* Directive 91/383 supplementing the measures to encourage improvements in the safety and health at work of workers with a fixed duration employment relationship or a temporary employment relationship
* Directive 89/654/EEC concerning the minimum safety and health requirements for the workplace
* Directive 89/655/EEC concerning the minimum safety and health requirements for the use of work equipment by workers at work
* Directive 89/656/EEC concerning the minimum health and safety requirements for the use by workers of personal protective equipment at the workplace

* Directive 2002/44/EC on the minimum health and safety requirements regarding the exposure of workers to the risks arising from physical agents (vibration)
* Directive 2003/10/EC on the minimum health and safety requirements regarding the exposure of workers to the risks arising from physical agents (noise)
* Directive 2004/40/EC on the minimum health and safety requirements regarding the exposure of workers to the risks arising from physical agents (electromagnetic fields)
* Directive 2006/25/EC on the minimum health and safety requirements regarding the exposure of workers to risks arising from physical agents (artificial optical radiation)
I henhold til EØS-avtalen skal ESA utarbeide rapporter vedrørende det aktuelle direktiv i samme utstrekning som Kommisjonen skal utarbeide slike rapporter. I praksis blir rapporten utarbeidet på bakgrunn av norske myndigheters svar på et spørreskjema utarbeidet av ESA.
2. Gjeldende norsk rett på området og behov for endringer i lov og forskrift
Det vil ikke være behov for lov- eller forskriftsendringer.
3. Norske interesser
Direktivet innebærer bare en ren teknisk forenkling i forhold til tidsperioden og innholdet for rapporteringen i henhold til det enkelte direktiv på HMS-området. Ut over dette er ikke norske interesser berørt.
4. Administrative, økonomiske, budsjettmessige og rettslige konsekvenser
I og med at Norge allerede rapporterer på de ovennevnte direktivene, vil harmoniseringen av hyppighet og innhold neppe få særlige administrative, økonomiske, budsjettmessige eller rettslige konsekvenser.

Direktivet anses EØS-relevant og akseptabelt.
